eDiscovery for Mobile Devices: Navigating the Challenges of Digital Evidence

The prevalence of mobile devices in both personal and professional settings has made them a critical source of electronically stored information (ESI) in litigation. Text messages, call logs, messaging apps, and location data often hold key evidence, but collecting and reviewing mobile data presents unique challenges in legal discovery.

That’s why Proteus Discovery Group offers eDiscovery for Mobile Devices, a Continuing Legal Education (CLE) course designed to help legal professionals understand best practices for handling mobile evidence defensibly and efficiently.

Why Mobile Device eDiscovery Matters

From commercial litigation and employment disputes to criminal cases and regulatory inquiries, mobile devices play an increasing role in legal investigations. Courts now expect legal teams to handle mobile data with the same level of care as traditional ESI, making it crucial to:

• Understand what types of data can be collected
• Ensure defensible collection and preservation
• Manage privacy concerns and compliance obligations

Course Overview

The eDiscovery for Mobile Devices CLE course provides a structured approach to collecting and analyzing mobile data, covering:
• Matter Types That Require Mobile eDiscovery – Employment disputes, intellectual property litigation, internal investigations, and more.

• What Data Can Be Collected? – Text messages, call records, emails, browser history, collaboration app data, location tracking, and even deleted content.

• Collection Methods – Remote collection, full forensic imaging, targeted ESI extraction, and key challenges with Apple vs. Android devices.

• Expectations of Privacy – Understanding Bring Your Own Device (BYOD) policies, legal hold obligations, and case law on mobile data privacy (Paisley Park v. Boxill, Klipsch Group v. ePRO E-Commerce).

• Costs & Review Considerations – How mobile eDiscovery pricing models work, and best practices for reviewing mobile data in platforms like Relativity, Reveal, and Everlaw.

Challenges and Best Practices

Work with IT and cybersecurity teams to limit exposure and prevent further data loss.

Our course provides real-world guidance to help legal teams streamline mobile discovery, minimize risk, and ensure compliance with legal and ethical standards.

Real-World Example: The Dangers of Mishandling Mobile Data

High-profile cases, such as Heslin v. Jones (2022), have demonstrated the serious consequences of mishandling mobile data. In this case, inadvertent production of an entire phone’s contents raised issues of attorney competence, privilege, and ethical obligations—a stark reminder that legal teams must approach mobile discovery with caution. Similarly, in Paisley Park v. Boxill, failure to properly preserve mobile communications led to critical evidence disputes, highlighting the need for defensible collection and documentation processes. These cases underscore why legal teams must stay ahead of evolving eDiscovery challenges.

Who Should Take This Course?

This CLE is ideal for legal professionals involved in cases where mobile data is key, including:
• Attorneys handling litigation, investigations, and regulatory matters

• In-house counsel responsible for compliance and data governance

• Litigation support and eDiscovery professionals managing mobile evidence

• Digital forensics and cybersecurity specialists assisting with mobile collections

Stay Ahead in Mobile eDiscovery

As mobile devices continue to generate ever-growing amounts of evidence, legal teams must adapt to new technologies and legal standards. Proteus Discovery Group’s eDiscovery for Mobile Devices CLE equips professionals with the knowledge and tools needed to navigate mobile data discovery with confidence.
